On July 31, 2015 the parties in Texas v. USA (S.D. TX, Brownsville Div., No. 1:14-cv-00254) filed a joint status report and motion, stating, "the Court should cancel the currently scheduled August 19 hearing. In the alternative, the Court should excuse the attendance of Secretary Johnson and the other high-ranking officials except Director Rodríguez, and permit the above-described substitution of witnesses. In any event, the Government respectfully requests a ruling on this motion no later than August 10, 2015, and a stay of the hearing pending appellate review should the request for substitution of witnesses be denied."
