Knowledge & Research Consultant Tip: Include patents when researching expert witnesses

When conducting research on expert witnesses, consider patents as a possible resource. Ask yourself if it is possible that the experts you’re researching have invented a device or process that may have been patented.

Searching an expert’s name in LexisNexis TotalPatent One® can provide some eye-opening information you should know about your experts; especially opposing counsel’s experts. For example:

  • Connections between inventors and companies they may have assigned their patents to (or that are owned by specific companies)
  • Technical information on what was patented, including information on earlier versions and how the new patent improves the old or overcomes flaws

Could the expert’s previous work be cited in someone else’s patent? Patents citing experts can provide support or dismissal of the expert’s work in their fields.
