FTC and DOJ Issue Draft Merger Guidelines

On July 19, 2023, the DOJ and FTC issued proposed Merger Guidelines which will replace the 2010 Horizontal Merger Guidelines and the 2020 Vertical Merger Guidelines. The proposed Merger Guidelines are consistent with the Biden-era approach to stricter enforcement of the antitrust laws.
