    • Federal: The NLRB adopts a Final Rule amending its procedures governing representation elections, reversing 2019 amendments, and returning to procedures established by a 2014 rule. See 88 Fed. Reg. 58076 (August 25, 2023).
    • Federal: The Fifth Circuit Court of Appeals reverses previous legal precedent that limited the scope of Title VII claims to "ultimate employment decisions," holding that Title VII applies to claims of discrimination in hiring, firing, compensation, or the "terms, conditions, or privileges" of employment. See Hamilton v. Dallas County, No. 21-10133 (5th Cir. 2023).
    • California: The California Supreme Court holds that an employer's business entity agents can be held liable for employment discrimination under the state Fair Employment and Housing Act. See Raines v. United States Healthworks Med. Grp., 2023 Cal. LEXIS 4619 (Aug. 21, 2023).
