  • Illinois: Illinois amended the Illinois Freedom to Work Act (IFWA) to impose greater restrictions on non-competes, including (1) prospectively voiding such agreements if employees earn $75,000 or less, (2) prospectively voiding non-solicitation agreements if employees earn $45,000 or less, (3) imposing specific notice requirements on employers, (4) codifying Illinois case law regarding the reasonableness of restrictive covenant provisions, (5) voiding non-competes where employees lost their positions for reasons related to COVID-19, and (6) adopting measures to dissuade employers from bringing enforcement actions, including awarding employees attorney’s fees and costs for successfully defending such actions. See 2021 Bill Text IL S.B. 672.
  • Pennsylvania: In a binding decision, the Superior Court of Pennsylvania has held that employees have a private right of action against employers under the Pennsylvania Medical Marijuana Act. See Palmiter v. Commonwealth Health Sys., Inc., 2021 PA Super 159 (PA Super. Ct. August 10, 2021).
