Nineteen states are considering bills that would limit the use of third-party software relying on competitor data to set rental housing prices, according to analysis by the American Economic Liberties Project, a non-profit, non-partisan, anti-monopoly think tank. New York enacted such a law (SB 7880) in October, while California enacted a broader law (AB 325) banning the use of price algorithms trained on “nonpublic competitor data” the same month. The U.S. House Judiciary Committee advanced legislation (HR 2675) aimed at increasing transparency and oversight of third-party litigation by foreign persons. U.S. Sen. John Kennedy (R-LA) has introduced a companion version of the “Protecting Our Courts from Foreign Manipulation Act” in his chamber.
