D.C. Federal Judge: Atmosphere Is Not A Public Trust Resource

WASHINGTON, D.C. - A federal judge in the District of Columbia on May 31 dismissed with prejudice a lawsuit brought by five young citizens and two environmental groups seeking a reduction in greenhouse gas (GHG) emissions after finding that the court lacked jurisdiction to hear their public trust doctrine claim and ruling that they failed to state a claim upon which relief could be granted (Alec L., et al. v. Lisa Jackson, et al.,  No. 11-cv-02235, D. D.C.; 2012 U.S. Dist. LEXIS 75791).
