2nd Circuit: Dismissal Of Aiding And Abetting Claims In Securities Suit Improper

NEW YORK - A Second Circuit U.S. Court of Appeals panel on Aug. 8 ruled that a federal judge erred in dismissing the Security and Exchange Commission's lawsuit against a former executive officer of Terex Corp. because the SEC properly showed that the defendant aided and abetted in a primary violation of federal securities law (Securities and Exchange Commission v. Joseph F. Apuzzo, No. 11-696, 2nd Cir.; 2012 U.S. App. LEXIS 16510).
