2nd Circuit Finds Class Certification In Google Library Project Case Premature

NEW YORK - A New York federal judge should first have made a determination of the merits of the "fair use" defense brought by Google Inc. before certifying a class of author plaintiffs, a Second Circuit U.S. Court of Appeals panel ruled July 1, vacating the certification order and remanding the copyright dispute over the Google Library Project (GLP) for further proceedings (The Authors Guild, et al. v. Google Inc., No. 12-2402, 2nd Cir.).
