Michigan State Jury Awards $5 Million To Family Of Pedestrian Struck And Killed By SMART Bus
June 9, 2016 - On Nov. 25, 2014, Sally LaMay was legally walking through a green signal at a cross walk at Crooks Road and Maplelawn Drive when she was struck by a bus owned/operated by defendant Suburban Mobility Authority for Regional Transportation (SMART) that had been attempting to turn left. She died as a result of multiple blunt force trauma. Sally was 37 years old and survived by her husband and two minor children.
Plaintiff Shane LaMay filed a wrongful death action against SMART on Nov. 25, 2014, in the Circuit Court of Oakland County, Michigan. The action was assigned to Judge Nanci J. Grant and proceeded to a jury trial. SMART disputed that the decedent suffered when she was struck by the bus, claiming that she was killed instantly. On May 13, 2016, the jury returned a verdict awarding plaintiff $ 5,000,000.
