Denver Jury Awards $ 695,000 To Fraternity After House Taken By University
Plaintiff Phi Kappa Sigma Building Corporation of Colorado (PKS) operated a social fraternity with a chapter located at defendant Colorado Seminary (CS) a/k/a Denver University. PKS leased a house/property from CS, where its members lived. Plaintiff Edward J. Collado was a board member and chapter advisor of PKS. On Nov. 2, 2012, CS terminated the lease, use, and possession of the house by PKS, who claimed that such termination was a breach of the lease without a fair and impartial hearing. PKS also claimed that CS interfered with its leases with sub-tenants and forcibly removed them without resorting to court process. Additionally, PKS alleged that CS allowed it to improve the property in September of 2012 when it knew of the pending eviction, and that CS employees had trespassed on and searched the real property and taken personal property belonging to subtenants. Collado claimed that he was accosted by CS employees.
PKS filed a complaint in the District Court for the City and County of Denver Colorado seeking valuation and payment of its interest in the house per the terms of the Lease. On Oct. 31, 2014, the jury returned a verdict awarding PKS $ 695,000. On Nov. 7, 2014, Judge Kenneth Laff entered judgment in favor of PKS and against CS in the amount of $ 810,216 including prejudgment interest. On Dec. 29, 2014, the court awarded costs to PKS in the amount of $ 25,965.86.
