Driver Who Fell Off Steep Embankment Reaches $ 1.9 Million Settlement With City In His California State Negligence Action
On Aug. 23, 2010, Nicholas Loeb was severely and permanently injured when the vehicle he was driving fell off of the roadway and down a cliff while he was on Lisbon Lane between Sandall Lane and Crater Lane in Los Angeles, California.
On Jan. 24, 2011, Loeb filed a complaint against the City of Los Angeles and others in the Superior Court of the State of California for the County of Los Angeles, alleging a dangerous condition of public property. More specifically, Loeb alleged, among other things, that defendants failed to adequately maintain and repair the property, provide protections against persons failing off of the steep embankment, and warn of the dangerous condition. A first amended complaint was filed on Feb. 1, 2012.
At a June 2, 2016 final status conference presided over by Judge NancyL. Newman, the case settled. On Aug. 17, 2016, the Los Angeles City Council approved the payment of $ 1,900,000 to settle the case, according to news reports.
