USCIS, Jan. 26, 2021
"On Nov. 4, 2020, the U.S. District Court for the Western District of Washington held a fairness hearing on the Mendez Rojas settlement agreement and approved the final settlement agreement.
In accordance with the agreement, USCIS has updated the Form I-589 filing information and asylum information on our website.
BackgroundOn June 30, 2016, a group of organizations filed a class action lawsuit against USCIS, U.S. Immigration and Customs Enforcement, U.S. Customs and Border Protection, and the Executive Office of Immigration Review. They claimed that the government did not provide proper notice of the asylum statutory one-year filing deadline to members of the proposed class, consisting largely of aliens who were apprehended at the border, and that the government did not provide an adequate mechanism for class members to timely file their Form I-589.
You can find the settlement agreement on our website.
