"President Joe Biden hopes to broker a solution to the migrant crisis when he meets with his Mexican and Canadian counterparts this week, but his efforts may be limited by the fact that much of his immigration agenda remains tied up in court. ... It's not yet clear if the Biden administration can craft the new rule in a way that can withstand legal challenge but also be effective. "The devil will be in the details: How will the administration define a credible fear? How much time will people have to prepare for their hearing?" said Stephen Yale-Loehr, a Cornell Law School professor who specializes in immigration. "If only a few days or weeks, few people will be able to gather their evidence or find an attorney." ... "Organizations have sued to stop administrative changes on both substantive and procedural grounds," Yale-Loehr said. "Groups can usually find sympathetic judges to (halt) an administration’s immigration policy change."
