Partner Seth Lamden will be presenting a program entitled "Excess Insurance: Questions Raised by Qualcomm and Issues Relating to the Duty to Defend" at the American Conference Institute's 2nd National Forum on Insurance Allocation at the Omni Chicago Hotel on the Magnificent Mile June 25-26, 2015. The following questions will be addressed in the presentation:
· Does a primary carrier’s settlement for less than its full limits trigger the excess policy status?
· Where do key jurisdictions stand with respect to these issues?
The program will discuss settlement considerations when in a Qualcomm jurisdiction, case law regarding duty to defend by excess carriers, and case law regarding possible drop down by excess carriers.
