ETA Previews Upcoming Adverse Effect Wage Rates (AEWR) for Range and Non-Range H-2A Occupations

"The Employment and Training Administration (ETA) will publish two Federal Register Notices (FRNs) in mid-December 2024. The first FRN will update the AEWR under the H-2A temporary agricultural employment program that applies to all range H-2A job opportunities for which the AEWR is determined using the Bureau of Labor Statistics (BLS) September 2024 Employment Cost Index (ECI). The second FRN will update the AEWRs under the H-2A temporary agricultural employment program that apply to the majority of non-range H-2A job opportunities for which the AEWRs are determined using the United States Department of Agriculture (USDA) October 2024 Farm Labor Survey (FLS). The final rule, Adverse Effect Wage Rate Methodology for the Temporary Employment of H–2A Nonimmigrants in Non-Range Occupations in the United States, 88 FR 12760 (Feb. 28, 2023), established the methodology for setting hourly AEWRs based on the USDA’s FLS for non-range H-2A job opportunities that are either: (1) in six Standard Occupational Classification codes comprising the field and livestock workers (combined) category, and (2) in the field and livestock workers (combined) occupational category that are located in States or regions, or equivalent districts or territories, in which the FLS reports wages. In order to ensure employers are aware of the coming updates, we are providing a preview of upcoming wage changes based on the September 2024 ECI results, published on October 31, 2024, and the October 2024 FLS results, published on November 20, 2024. Please refer to the FRNs, once published, for the effective dates of the new AEWRs.
