"Straight Up Dishonesty" - Judge Orders ICE to Depopulate Adelanto

Read Judge Hatter's Oct. 15, 2020 Order here, especially pages 2-3: "The Court has been concerned for some time with the lack of candor exhibited by the Government and its counsel in this case. Counsel for Petitioners-Plaintiffs have, also, raised similar concerns. Until now, the Court has given the Government and its counsel the benefit of the doubt. Now, the Court is concerned with straight up dishonesty on the part of the Government’s counsel. It is rare that a Court is presented with direct evidence of dishonesty. Usually, the Court needs to evaluate aspects of veracity to reach an inference of dishonesty. However, the Government provided the Court with a blaring example of its dishonesty. ... This case involves human lives whose reasonable safety is entitled to be enforced and protected by the Court pursuant to the United States Constitution. Accordingly, the Court is contemplating the appointment of a Special Master, to be paid by the Government, to ensure that the information the Court receives in this case is both accurate and timely."

Read the details in the Palm Springs Desert Sun: "A federal judge is ordering government officials to immediately reduce the population at the Adelanto ICE Processing Center in San Bernardino County so detainees can practice social distancing amid a coronavirus outbreak at the facility. Starting Monday, U.S. Immigration and Customs Enforcement officials must begin reducing the facility's population by at least 50 detainees each day, either by releasing or deporting them, until there are 475 people or less housed there, Senior U.S. District Judge Terry Hatter Jr. said in an order issued Thursday. The 1,940-bed Adelanto facility, which is one of the largest ICE detention centers in the country and was recently green-lit to expand, housed 772 detainees as of Oct. 5, according to ICE. The detention center is owned and operated by private prison company The GEO Group."

and the San Bernardino Sun: "A U.S. District Court judge on Thursday, saying he was “concerned with a lack of candor and honesty,” ordered the federal government to reduce its prisoner population at the Adelanto ICE Processing Center by more than 38 percent beginning Monday. Judge Terry J. Hatter ordered ICE to release 50 prisoners a day beginning Monday until the private prison’s population whittles down from 772 to 475. “The Court has been concerned for some time with the lack of candor exhibited by the Government and its counsel in this case. Now, the Court is concerned with straight up dishonesty on the part of the Government’s counsel,” Hatter wrote in his 15-page order."
