Mealey's IP/Tech - Fees, Costs, Awarded After Voluntary Dismissal Of Patent Case Will Stand

WASHINGTON, D.C. - The Federal Circuit U.S. Court of Appeals ruled Dec. 16 that a patent owner that voluntarily dismissed its infringement claim and entered into a covenant not to sue must nonetheless pay a defendant $363,243 in attorney fees and costs (Blackbird Tech LLC v. Health in Motion LLC, et al., No. 18-2393, Fed. Cir., 2019 U.S. App. LEXIS 37036).
