Mealey's Labor & Employment - D.C. Circuit Enforces NLRB Ruling After Employer Doesn't Challenge Merits

WASHINGTON, D.C. - A District of Columbia Circuit U.S. Court of Appeals panel on Jan. 27 denied an employer's petition for review of a matter concerning a firing for striking and granted a cross-application for enforcement by the National Labor Relations Board, ruling that the employer failed to show that the Railway Labor Act (RLA) controlled and failed to challenge the merits of the NLRB's findings (American Sales & Management Organization, LLC v. National Labor Relations Board, No. D.C. Cir., 2020 U.S. App. LEXIS 2599).
