9th Circuit Upholds Labor Board's Ruling Against Hospital

SAN FRANCISCO - The Ninth Circuit U.S. Court of Appeals on March 26 affirmed a National Labor Relations Board ruling that a hospital's actions violated the National Labor Relations Act (NLRA) and upheld a decision not to reopen the record to allow the hospital to present evidence that a supervisor whose actions were in question was exempt from NLRA protection as a registered nurse (National Labor Relations Board v. Barstow Community Hospital-Operated by Community Health Systems, Inc., No. 10-73450, 9th Cir.; 2012 U.S. App. LEXIS 6169).
