Federal Circuit Reverses Inequitable Conduct Ruling In Patent Case

WASHINGTON, D.C. - Although agreeing with a Michigan federal judge that an asserted patent claim is invalid as obvious, the Federal Circuit U.S. Court of Appeals on June 18 reversed findings that the patent as a whole is unenforceable due to inequitable conduct (Novo Nordisk A/S and Novo Nordisk Inc. v. Caraco Pharmaceutical Laboratories Ltd., No. 11-1223, Fed. Cir.).
