N.Y. Justice Denies Motion Seeking Trial Preference For Non-City Exposure Case

NEW YORK - Although asbestos case management orders technically permit granting trial preference to individuals without exposure in one of the five boroughs, precedent and the court's inherent authority permit denying such status, a New York justice held in an opinion posted Sept. 13. The plaintiffs will appeal the ruling, according to the court's docket (Robert Stitt and Helen Stitt v. Burnham Corp., et al., No. 190478/12, N.Y. Sup. New York Co.; 2013 N.Y. Misc. LEXIS 4049).
