Judge Dismisses Majority Of Environmental Group's Suit Over Emissions

HOUSTON - A federal judge in Texas on March 28 ruled that although the Texas Campaign for the Environment (TCE) had standing to bring a Clean Air Act (CAA) lawsuit over emissions from the Fayette Power Project's (FPP) three coal-fired steam electric generating units, it could not pursue claims that the emissions were in excess of permits obtained by the owners and operators of the facility (Texas Campaign for the Environment v. Lower Colorado River Authority,  No. H-11-791, S.D. Texas; 2012 U.S. Dist. LEXIS 42486).
