New Evidence Leads Judge To Find Insurer Improperly Investigated Dog Attack Claim

MARTINSBURG, W. Va. - In light of newly submitted evidence, a West Virginia federal judge on Aug. 14 granted a motion for reconsideration by defendants in a declaratory action, finding that a proper investigation would have shown that coverage for a dog attack incident was clearly available under the defendants' homeowners insurance policy (Nationwide Mutual Fire Insurance Co. v. Boyd S. Faircloth, et al., No. 3:12-cv-00004, N.D. W.Va.; 2013 U.S. Dist. LEXIS 114838).
