Federal Circuit: Employee Lacks Procedural Rights Related To Security Clearance

WASHINGTON, D.C. - The Merit Systems Protection Board (MSPB) erred when it ruled that due process provides a federal employee with procedural rights related to a security clearance determination, the Federal Circuit U.S. Court of Appeals ruled Aug. 16 (Joseph T. Gargiulo v. Department of Homeland Security, No. 2012-3157, Fed. Cir.; 2013 U.S. App. LEXIS 17014).
