Panel Says Insolvent Insurer Breached Duties To Follow Claims-Adjustment Procedures

NEW ORLEANS - An insolvent insurer breached its obligations to follow claims-adjustment procedures, the Fifth Circuit U.S. Court of Appeals affirmed Sept. 9, rejecting the insurer's claim for the remaining $604,435 in deductible losses (Michael F. Consedine, Pennsylvania insurance commissioner, as statutory liquidator of Reliance Insurance Co. v. Personnel Management Inc., No. 11-31202, 5th Cir.; 2013 U.S. App. LEXIS 18727).
