Mealey's Bankruptcy - 5th Circuit: Debtor's Divorce Obligation To Ex-Wife Is Nondischargeable

NEW ORLEANS - A panel of the Fifth Circuit U.S. Court of Appeals on Feb. 7 ruled that a bankruptcy court properly held that a debtor's divorce obligation to his former wife was nondischargeable in bankruptcy because his repeated refusal to pay her constituted "a willful and malicious injury" under the Bankruptcy Code (Michael Vernon Shankle v. Dianne Shankle [In The Matter of: Michael Vernon Shankle], No. 13-60251, Chapter 7, 5th Cir.; 2014 U.S. App. LEXIS 2356).
