Mealey's Insurance - Letter Triggered Coverage, But Denial Was Not Bad Faith, 11th Circuit Panel Affirms

NEW ORLEANS - The 11th Circuit U.S. Court of Appeals on June 11 affirmed that an insurer's denial of coverage did not constitute bad faith because the insurer did not believe that the receipt of a potentially responsible party (PRP) letter from the U.S. Environmental Protection Agency by its insured triggered liability coverage (Alabama Gas Corp. v. Travelers Casualty and Surety Co., et al., No. 13-14345, 11th Cir.; 2014 U.S. App. LEXIS 10856).
