Mealey's Elder Law - California Panel Rejects Rehearing, Mandate Request In Health Code Case

SAN FRANCISCO - A California appellate panel in an Aug. 21 order modifying its opinion and denying a request for rehearing rejected a nonprofit nursing home rights advocate's request that it order the trial court on remand to issue a mandate requiring nursing facilities using California Health and Safety Code Section 1418.8 to make decisions for incapacitated nursing residents without someone with legal authority to adopt and adhere to the additional procedures the appellate court specified in its original opinion (California Advocates for Nursing Home Reform, et al. v. Karen Smith, et al., No. A147987, Calif. App., 1st Dist., Div. 4, 2019 Cal. App. LEXIS 776).
