Mealey's IP/Tech - Respondent Asks Supreme Court To Deny Facebook Certiorari In TCPA Dispute

WASHINGTON, D.C. - A man who sued Facebook Inc. for violation of the Telephone Consumer Protection Act of 1991 (TCPA) filed a brief opposing the social network's petition for certiorari on Jan. 3, telling the U.S. Supreme Court that there is no circuit split over the definition of an automatic telephone dialing system (ATDS) under the statute and arguing that Facebook lacks standing to seek review of the Ninth Circuit U.S. Court of Appeals' finding that an amendment to the act is unconstitutional but severable (Facebook Inc. v. Noah Duguid, et al., No. 19-511, U.S. Sup.).
