The Trademark Modernization Act (TMA) was enacted to amend the Lanham Act and took effect in December 2021. Looking at the impact of the enactments it becomes clear that the TMA giveth and the TMA taketh away. The TMA brings three key changes to the Lanham Act. The TMA: 1. Allows for easier injunctive relief for owners. 2. Makes it easier for the USPTO to cancel registrations and 3. Shortens response deadlines to office actions.
