Description
Focusing on misrepresentation and the occasionally indistinct line between permitted negotiation communications and prohibited deception, the faculty will discuss:
- Obeying substantive rules of law
- What constitutes a material misrepresentation or material facts
- Correcting errors or misunderstandings to avoid detrimental reliance
- Moral or ethical consequences of a proposed course of action
- Refusing to engage in a particular course of conduct; withdrawal from representation
- Preventing a client from cheating or defrauding others
- Model Rules 1.2, 1.6, 1.16, 2.1, 3.3, and 4.1
