In this session, you will learn how the Model Rules of Professional Conduct pertain to lawyers and law firms’ use of data analytics for case strategy and business development. You will understand how analytics inform counsel’s ability to assess the unique experiences of the court, judge, parties & counsel involved in a case, as well as the ethical considerations that come into play in this process.
As a result of attending this session, the learner will be better able to:
• Identify situations in which analytics enable data-informed decisions for litigation strategy and business development.
• Identify ethical rules relevant to common use-case scenarios for using analytics in practice.
• Navigate ethical boundaries for touting an attorney or firm’s previous results.
