Learn about the National Interest Waiver (NIW) process. Recently, the NIW petition has garnered significant attention as a pathway to Lawful Permanent Resident status that does not require completion of the increasingly lengthy PERM process. The program provides a short overview of the NIW category, including the legal requirements, and then delves into the realities of the category as a matter of immigration practice. The faculty lay out the pros and cons of the NIW category in comparison with other I-140 categories, including the EB-1 category, as well as up-to_x0002_date trends being seen with respect to adjudication as well as Requests for Evidence (RFE). Finally, with the upcoming administration change in January, the faculty discuss potential impacts to the NIW petition process, including adjudication.
