Mealey's Elder Law - Split 6th Circuit Reverses Remand Of VA Benefits Dispute, Orders Dismissal

CINCINNATI - A divided Sixth Circuit U.S. Court of Appeals panel on July 10 reversed a trial court's remand order in an estate's case seeking the return of a veteran's disability benefits and ordered dismissal, ruling that there was a lack of subject matter jurisdiction (In Re: Estate of Jerry West v. United States Department of Veterans Affairs, Nos. 16-6252/6360, 6th Cir., 2018 U.S. App. LEXIS 18710).
