Mealey's Franchise - Judge: Distributor Agreement Choice Of Law Provision Applies To Common-Law Claims

CAMDEN, N.J. - The choice of law provision in a distributor agreement between a gun company and a New Jersey business applies to state common-law claims filed after the agreement was terminated, but will not apply to claims for unlawful termination and engagement in prohibited practices under the New Jersey Franchise Practices Act (NJFPA) if it can be shown that the two parties' relationship constitutes a franchise, a New Jersey federal judge ruled June 29, granting in part and denying in part a motion to dismiss and granting the plaintiff 30 days to replead some of its claims (Lawmen Supply Company of New Jersey, Inc. v. Glock, Inc., No. 17-6166, D. N.J., 2018 U.S. Dist. LEXIS 108740).
