Plan Properly Denied Additional Service Credits, 6th Circuit Holds

CINCINNATI - A multiemployer pension plan did not act arbitrarily and capriciously in denying a participant's claim for additional service credit, the Sixth Circuit U.S. Court of Appeals affirmed May 17 in an unpublished opinion, concluding that the decision "was the result of a multi-year process that included two administrative appeals and was based on evidence in the administrative record" (Larry Lewis v. Central States, Southeast & Southwest Areas Pension Fund, et al.,  No. 10-4259, 6th Cir.; 2012 U.S. App. LEXIS 10114).
