Judge Declares Professional Liability Insurance Policy Void Ab Initio, Rescinded

ORLANDO, Fla. - A Florida federal judge declared on June 4 that a lawyers professional liability insurance policy is void ab initio and rescinded pursuant to Florida Statutes Sections 627.409(1)(a) and 627.409(1)(b), one day after finding that the law firm insured's misrepresentations on the insurance application were material to the insurer's acceptance of the risk (Darwin National Assurance Co. v. Brinson & Brinson, et al., No. 11-cv-1388, M.D. Fla.; 2013 U.S. Dist. LEXIS 77635).
