8th Circuit Reverses Dismissals Of ATM Fees Actions

ST. LOUIS - The Eighth Circuit U.S. Court of Appeals on Aug. 2 reversed the dismissal of a consumer's putative class actions alleging that two financial institutions violated the Electronic Fund Transfer Act (EFTA) by not posting ATM fees notices, finding that the consumer had standing to pursue his claims based on the informational injury that he allegedly sustained (Jarek Charvat v. Mutual First Federal Credit Union, Jarek Charvat v. First National Bank of Wahoo, Nos.12-2790, 12-2797, 8th Cir.; 2013 U.S. App. LEXIS 15937).
