Mealey's Insurance - Judge Rules On Dismissal Motions In Suit Challenging Defendants' Claims Handling

COLUMBUS, Ohio - A federal judge in Ohio on Jan. 17 granted individual defendants' motion to dismiss bad faith and other claims in a lawsuit alleging that they erred in handling the plaintiff's underlying insurance claims, finding that the individual defendants do not have a contractual relationship with the insured and, as a result, "do not have a corresponding personal duty in their individual capacities to act in good faith" (Merrilee Stewart v. The Hartford Financial Services Group, Inc., et al., No. 19-304, S.D. Ohio, 2020 U.S. Dist. LEXIS 8375).
