Learn about the PERM labor certification process with the U.S. Department of Labor, and how the post-COVID work-from-home landscape, and emerging and shifting wage transparency laws, have impacted this process. In a new world of emerging remote work and accommodations, employers must ensure they remain compliant in all stages of the PERM process, including the prevailing wage request and recruitment. The layoff of remote workers has also added an additional layer of complexity to this process given that PERM is location-specific, and employers must ensure continued compliance. Finally, hear the faculty examine the wage transparency laws in different states and what steps should be taken to ensure compliance during the PERM process.

Despite the FTC’s attempt to ban noncompetes, they remain in use by businesses across the country. With its professed business-friendly perspective, the new administration likely will detour from FTC’s employee-friendly approach, leaving noncompete issues to the states and the existing patchwork of laws. The legal landscape surrounding noncompete agreements continues to rapidly evolve, with significant developments at both state and federal levels. These changes bring new challenges to employers and employees attempting to navigate varying legal standards, particularly for companies with multistate operations. The complexities are compounded by updates from the FTC, NLRB, and the introduction of new wage thresholds that directly impact the scope, enforceability and fairness of such agreements. Help business clients mitigate risks, protect assets, maintain their competitive edge, and optimize their marketability in the job market, and help employee clients recognize unlawful noncompetes and maximize their options, with a keener understanding of what noncompete agreements look like today with the lessons learned during this webcast. Taught by seasoned employee and employer advocates Rachel Green and Paul Kennedy, respectively, this crisp and thorough webcast highlights the tools and insights you need – register today!

Learn about the National Interest Waiver (NIW) process. Recently, the NIW petition has garnered significant attention as a pathway to Lawful Permanent Resident status that does not require completion of the increasingly lengthy PERM process. The program provides a short overview of the NIW category, including the legal requirements, and then delves into the realities of the category as a matter of immigration practice. The faculty lay out the pros and cons of the NIW category in comparison with other I-140 categories, including the EB-1 category, as well as up-to_x0002_date trends being seen with respect to adjudication as well as Requests for Evidence (RFE). Finally, with the upcoming administration change in January, the faculty discuss potential impacts to the NIW petition process, including adjudication.

In a landmark ruling with far-reaching consequences for federal agencies and the regulated community, the Supreme Court overturned the 40-year-old Chevron doctrine. The Court’s Loper Bright v. Raimondo and Corner Post Inc. v. Board of Governors of the Federal Reserve System decision fundamentally changes Chevron deference, requiring courts to interpret laws independently without relying on agency expertise. This decision means courts must exercise “independent judgment” and give a statute its “best meaning” rather than accepting “reasonable” agency interpretations. How will this decision reshape administrative law and affect labor and employment cases to come?
